2. Purpose and acceptance

This document governs access to, navigation within and use of the Service. By registering, accessing or using the App you acknowledge that you have read and fully accept these Terms and our Privacy Policy. If you do not agree, you must refrain from using the Service.

3. Registration and eligibility

1. Be 18 years of age or older and have legal capacity.
2. Complete the account-creation process via e-mail, Apple ID or Google Sign-In.
3. Provide truthful information and keep it up to date.
4. Use of third-party accounts or multiple registrations is not permitted.

We detect and cancel suspicious accounts or accounts belonging to minors.

4. Main services and features

• Onboarding: habit questionnaires and photo upload.
• Discover: browse profiles with filters (certain filters reserved for paid plans).
• Correspondence: turn-based messaging (“letters”).
• Community / Club: in-person events and exclusive content.
• Subscription: Plus and Club plans that unlock premium features.
• Profile & settings: editing, privacy, payments and account deletion.

5. Subscription plans, payments and billing

1. Freemium model: free download and basic functions; advanced features via paid subscription (in-app purchases through the Apple App Store and Google Play Store).
2. Management and cancellation: handled from the relevant app-store account.
3. Taxes: prices include VAT applicable in the country of the app store where the subscription is purchased.
4. Auto-renewal: subscriptions renew for equal periods unless cancelled in advance.

6. Right of withdrawal and refunds

Payments are processed by the app stores. Any refund request must be handled in accordance with Apple or Google policies, as applicable. Tabaiba does not process refunds directly. Review the specific store conditions before buying.

7. Account cancellation and deletion

• In-App: Delete account option under Settings.
• Subscriptions: must be cancelled in the App Store or Google Play to avoid future charges.
• Once the account is deleted, we will retain certain data for the legally required periods (e.g. tax) as described in the Privacy Policy.

8. Community rules

1. Authenticity: use your real name and photos showing your face.
2. Respect: no harassment, hate, discrimination or violence.
3. Prohibited content: explicit sexual content, minors, illegal drugs, spam, scams, impersonation.
4. Privacy: do not post personal data (phone, address, card number).
5. Offline behaviour: harmful conduct outside the App may lead to internal sanctions.
6. Enforcement: warnings, suspension or permanent closure depending on severity.
7. Reports: in-app reporting tools; each case reviewed by human moderators.

9. User content and licences

• Ownership: you remain the owner of your content.
• Licence to Tabaiba: you grant us a worldwide, free, non-exclusive, revocable licence to display your content within the Service and to make technical adaptations (caching, thumbnails, etc.).
• Third-party use: downloading, distributing or exploiting other users’ content without their consent is prohibited.
• Moderation: we combine automated and human reviews to remove content that violates these Terms or the law.

10. Tabaiba intellectual property

All elements of the Service (software, design, name, logos, algorithms, databases, etc.) belong to Tabaiba or its licensors and are protected by intellectual-property law. We grant you a limited, personal, non-transferable and revocable licence to use the App in accordance with these Terms.

11. Third-party services and links

We may integrate or link to third-party services, e.g. PostHog, OneSignal, Adapty. Tabaiba is not responsible for their availability or practices. Use of such services may be subject to their own terms.

12. Data protection and privacy (GDPR)

• Legal bases: performance of a contract, consent, legitimate interest and legal compliance.
• Purposes: account management, matches, events, analytics, security and billing.
• Approximate geolocation: we use the location you yourself provide in writing to improve the weekly selection.
• Rights: access, rectification, erasure, objection, restriction, portability, and complaint to the Spanish Data Protection Agency (AEPD).
• International transfers: safeguarded using Standard Contractual Clauses or equivalent mechanisms.
• Security: TLS encryption in transit and role-based access control.

13. Liability and warranties

1. The Service is provided “as is” and as available; we do not warrant error-free or uninterrupted availability.
2. We are not liable for indirect damages, data loss or decisions taken on the basis of information obtained in the App.
3. Our total liability to the user is limited, where applicable, to the amount actually paid in the twelve months preceding the event giving rise to liability.
4. Nothing herein limits non-waivable consumer rights under Spanish and European law.

14. Changes to the Terms

We may update these Terms to reflect legal, technical or business changes. We will notify you at least 30 days in advance via:

• e-mail,
• in-app banner or notice,
• push notifications (if enabled).

Continued use after the notice period implies acceptance of the new Terms. If you do not accept them, you must stop using the Service and delete your account.

15. Communications

Unless the law requires otherwise, we will use the e-mail address provided and in-App notifications for all contractual communications.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute the parties submit to the courts of Santa Cruz de Tenerife (Spain), unless an imperative rule establishes another venue.

17. Child protection and sexual-abuse content

Tabaiba has a policy of “zero tolerance” for any material that sexualises or exploits minors.

1. Express prohibition: publishing, requesting or sharing such content is forbidden.
2. Moderation and removal: our team reviews reports and immediately deletes the content and infringing accounts.
3. Reporting tool: the App includes a report button to quickly flag suspicious material or behaviour.
4. Cooperation with Spanish authorities: we will provide the necessary information when required by law.

18. Miscellaneous

• If any clause is declared null, the remaining clauses shall remain in force.
• Failure to exercise a right does not constitute a waiver.
• These Terms constitute the entire agreement between the parties regarding their subject matter.
